Council to Consider Dog Ordinance

Tonight the City Council will review a proposal to amend the city’s pet access rules to Willard Beach. Organizer Gary Crosby is hoping the Council will send the ordinance change to referendum for voters to decide in November.

A public hearing is scheduled as part of the deliberation. The proposed law change would ban dogs from Willard Beach for six months each year, from April-October. Off-season, pets would be allowed on the beach only if they are leashed.

The Council convenes at 7 p.m. Here is the position paper from the city’s corporate counsel:

SUBJECT:
ORDINANCE #1-09/10 – Public hearing and consideration of a citizen initiated proposed amendment to Chapter 3, “Animals & Fowl,” banning dogs from Willard Beach between April 15 and October 15. Council first reading and postponement to July 20, 2009 for final action or referral to the November 3, 2009 municipal general election ballot. Passage requires majority vote.
POSITION:
On May 20, 2009, a citizen initiative petition was submitted to the City Clerk’s office requesting amendment of the South Portland Code of Ordinances to prohibit dogs on Willard Beach between April 15 and October 15 and to require dogs to be “on leash under owner’s control during park hours” between October 16 and April 14. Pursuant to Article XI of the City Charter, South Portland voters may propose any
ordinance through the initiative process, except an ordinance appropriating money or authorizing the levy of taxes. (There are some other general limitations on the right of initiative not applicable to this proposed ordinance.) Petitions must be in the form set forth in Section 1103 of the Charter. Once an initiative petition is submitted to the City Clerk, the Clerk has 20 days to determine whether it contains a sufficient number of valid signatures and whether each paper of the petition has a proper statement of the circulator. The City Clerk has determined that the petition does contain the required
number of valid signatures and that each paper has a valid statement of the circulator.
Accordingly, she has forwarded it to the City Council. Once a certified initiative petition is received by the City Council, the City Council is required to have the proposed ordinance read and to hold a public hearing on it. Accordingly, the proposed ordinance has been placed on the agenda as a public hearing. The City Council must take final action on the proposed ordinance within 60
days of the date it receives it from the City Clerk.
If the City Council does not pass the proposed citizen-initiated ordinance as written, the proposed ordinance must be submitted to the voters at least 30 days but not
more than 15 months from the date of the City Council’s final vote thereon. Therefore, there are two options before the City Council as to how to proceed: (1) to move that this 2 serve as first reading of the proposed ordinance and postpone it to the meeting of July 20, 2009 for second reading and final action; or (2) to move to place the proposed ordinance on the ballot for the November 3, 2009 municipal general election.
REQUESTED ACTION:
Either:
1. Move that this serve as first reading of the proposed ordinance and postpone it to the meeting of July 20, 2009 for second reading and final action; or
2. Move to place the proposed ordinance on the ballot for the November 3, 2009 municipal general election.

An addendum to my previous post…..........Gary, nothing in the post about stopping people going on the Beach.  Of course if you finally want to admit that banning dogs from the Beach will in fact stop people going to the Beach…..........

Gary…........there are “laws” concerning dog access to the Beach which you and SWB want to change !
No matter how much you want to keep posting your ” doggy -doo” phobia, there is no health hazard from dogs at Willard Beach as advised by experts….......fact, not unqualifed conjecture by you. If information concerning any subject is not analysed by an expert it is just information subject to conjecture by the non- expert.
I note that you are still unable to come up with a verifiable expert to substantiate your claims.
People who are able to cope with everyday hygiene problems (using soap and water), who you wish to insinuate as being ignorant, use Willard Beach for their enjoyable beach activities without any ill-effects.

Anthony,  First off we can not stop people from going to the beach regardless of where they come from.  Contact Eric Carson and he can explain further.  There are laws that address it.  Second as hard as you may try to get away from this the CDC, etc recommends not playing in sand where animals defecate and urinate.  This has nothing to do with self diagnosis.

Gary…......I had not really heard from you espousing Willard Beach as a place for South Portland dogs only. Is that the next step for you and SWB down the “slippery slope” ? If you win in November, and if you get dogs from outside South Portland banned who or what is next ?
Nobody plays in dog faeces on Willard Beach…......your exaggeration in order to gain votes.
All the institutions you cite warn you against self diagnosis and to seek help with their information from an expert. You and the members of SWB are not experts.

He sent it to other papers as well and signed it from Falmouth further proof that people from other towns bring their dogs to our beach.

I don’t need a lengthy CV to know you shouldn’t play in dog crap.  Common sense should do it.  But if that’s not enough I refer you to the Fed CDC, State CDC, UMaine,State of MASS. and numerous other reputable organizations that will tell you and others not to let children play were animals defecate.  If that doesn’t work for you I am not sure what else to say.

Dear, dear Gary…........you are starting to sound a little desparate ! Of course I ask them about the dogs being on the Beach. Just what would the point of me asking any other questions ? Oh wait….....I do ask them if they are enjoying their day at the Beach, I mean that’s a permissable question is it not ?
As for the rest of your post it is the usual mishmash of misinformation, false information, exaggerated information that you and SWB spread in order to try win the referendum. As you obviosly think, according to your post, ” That’s because they don�t know what goes on ” that the public is ignorant and you can keep on posting your nonsense they will be persuaded. Let me tell you Gary, the people on the Beach that I have spoken to are not your supporters. I would not hope, if I were you, that the people voting in November know the “facts”. If they do….......you will lose !!
(Speaking of facts….....would you mind passing on a message to Steve for me ? Hitler was a Fascist the antithesis of socialism and communism, I wouldn’t want anybody to think he did not know what he is talking about !)

Gary, In the vein of the questions you just posed to Anthony:  When you enlighten the public, will you openly compare your resume and medical/ educational background with that of Dr. Howell?  Will you offer copies of both your own CV and that of Dr. Howell so your audience can make a truly informed position?


I’ve seen Dr. Howell’s cv posted a couple of times, but I have yet to see evidence or your own informed educational background.

Anthony,  Do you tell them the truth when you talk to them that they are playing right wear all the dogs where pooping and peeing that morning or every other day ? Do you tell them that some of the dogs lift a leg on the play ground equipment where their children are playing?  Do you point out that if they disagree with you that you will do what ever you can to discredit them and try to make them look like fools.  Do you tell them about your 2 experts?  That one admitted that he was not without bias and the other wants to come from Falmouth to let his dog play on the beach.  I seriously doubt you say any of that.  If they do so much as dare disagree with you in public you and others will twist their words and over exaggerate them trying to make them look like doomsayers.  If you had any good reasons for telling people it’s ok for them to play in your dogs toilet you would use it but instead you need to try to tear me down. Classic!  All I can hope for is in November people will know the facts and vote on them.  You guys are blinded by your passion at this point.  We have facts on our side.

Dogs do jump on people
Dogs do defecate and urinate on the play area of the beach and play ground
There is a health risk both disease and biting
Some people, young and old are scared of dogs
Most dogs are not under true voice control
Picnics have been ruined
People have been knocked over and cloths torn
Smaller leashed dogs have been attacked by larger off leash dogs
The new law allows for year round access of humans during park hours
The new law limits dog access to 6 months a year.
The new law will be voted on by the registered voters of South Portland. Not from out of town users.
The majority will decided.
